在用人单位发生变更时,外国劳动者应当根据不同情形重新办理工作许可证手续,或者经经原发证机关批准,并办理工作许可证变更手续。外国人在中国就业因为不能将用工单位和用人单位相分离,因此无法采用劳务派遣、指派到其他单位工作等用工形式。
